On April 7, 2004, the Securities and Exchange Commission (³SEC²) approved the new NASD Rule 3500 Series, which requires firms to do the following:

·      Establish emergency preparedness plans and procedures;

·      Enumerate certain requirements that each plan must address;

·      Update the plan upon any material change review of the plan;

·      Disclose their Business Continuity Plan (³BCP²) to customers.

 

Following is a summary of our BCP and the BCP of National Financial Services, LLC. (³NFS²), our clearance agent and the custodian of all customer assets, which summarizes how our business would operate in the event of a Significant Business Disruption (³SBD²).

 

Our plan anticipates two kinds of  SBDıs, internal and external. An internal SBD such as a fire in our office, would affect only our own firmıs ability to conduct business on presumably a short-term basis, while an external SBD such as a significant act of terrorism or health pandemic would disrupt the nation and probably the operations of the securities markets on a wide-scale, regional basis. The external SBD relies more heavily on other organizations and systems, especially on the capability of our clearance firm, NFS.

 

The main and only office of our firm is located at 19 East 71st Street, New York, NY 10021, in a (primarily) residential neighborhood of New York, and accessible by private and public transportation. Using computers and electronic devices, the firm is able to operate from a remote location. Peter Mack and other employees are able to communicate with NFS in a variety of methods from virtually anywhere where communication is possible and conduct business. This location is accessible by private or mass transit.  

 

Our firm does not maintain custody of clientsı funds or securities, which are held by National Financial Services, LLC, a Fidelity Investments Company. NFS maintains a BCP that allows their business to operate from multiple national locations in the case of a SBD.
